Candor man arrested for criminal sale of controlled substance

Martin H. Stuve, age 26 of 677 Spencer Rd., Apt. #1 in Candor, N.Y., was arrested for two counts of criminal sale of a controlled substance in the third degree, class B felonies, on Aug. 24, 2015.

On Aug. 24, 2015 at 7 p.m., the Tioga County Sheriff’s Office arrested Martin H. Stuve, age 26 of 677 Spencer Rd., Apt. #1 in Candor, N.Y. for two counts of criminal sale of a controlled substance in the third degree, class B felonies.

The charges were derived from an investigation conducted by the Tioga County Sheriff’s Office concerning illegal narcotics sales within Tioga County.

Martin H. Stuve was taken into custody in Candor, N.Y. following a grand jury indictment, which was presented by Tioga County District Attorney Kirk Martin.

Martin H. Stuve has other pending charges for possessing narcotics at the time of arrest.

Martin H. Stuve was taken to the Tioga County Jail and is waiting an appearance in the Tioga County Court before Judge Gerald Keene.

On Sept. 3, the Owego Police arrested Clarence Saxton, age 55 of the Village of Owego for Criminal Sale of a Controlled Substance 5th, a class D felony, Criminal Sale of a Controlled Substance 7th, a class A Misdemeanor, Endangering the Welfare of a Child, a class A Misdemeanor and traffic offenses. Clarence Saxton was arraigned in front of Justice Boland and remanded to the Tioga County Jail on $10,000 cash bail.

On Sept. 3, Owego Police arrest Dale Freeman, age 51 of Warren Center Pa. for Criminal Sale of a Controlled Substance 7th, a class A Misdemeanor. Dale Freeman was arraigned in front of Justice Boland and remanded to the Tioga County Jail on $2,500 cash bail.

On Sept. 4, the Owego Police arrested John Morris, age 38 of the Village of Owego for Aggravated Unlicensed Operation of a Motor Vehicle in the second degree, a Misdemeanor. John Morris was arraigned in Owego Village Court and remanded to the Tioga County Jail on $5,000 cash bail.

On Sept. 6, the Owego Police arrested Nichole Stables, age 28 of the Village of Owego for Harassment 2nd, a Violation. Nichole Stables was issued an appearance ticket to return to Owego Village Court on Oct. 6, 2015.

On Sept. 7, the Owego Police arrested Michael Krise, age 20 of the Town of Maine for Unlawful Possession of Fireworks, a Violation. Michael Krise was issued an appearance ticket to return to Owego Village Court on Oct. 6, 2015.

On Sept. 7, the Owego Police arrested Lynn Lyons, age 19 of Binghamton, N.Y. for Unlawful Possession of Fireworks, a Violation. Lynn Lyons was issued an appearance ticket to return to Owego Village Court on Oct. 6, 2015.

On Sept. 7, the Owego Police arrested Tiffany Floyd, age 27 of the Village of Owego for Disorderly Conduct, a Violation. Tiffany Floyd was released on an appearance ticket and was expected to return to Village Court on Sept. 15, 2015.

On Sept. 7, the Owego Police arrested Hope Cole, age 45 of the Village of Owego for Resisting Arrest, a Class A Misdemeanor. Hope Cole was arraigned in the Village of Owego Court and later remanded to the Tioga County Jail on $2,500 cash bail.

On Sept. 7, the Owego Police arrested Miles Floyd of the Village of Owego for Reckless Endangerment, a Class A Misdemeanor. Miles Floyd was arraigned by Justice Craig and remanded to the Tioga County Jail on $5,000 cash bail.

On Sept. 7, the Owego Police arrested Wayne Floyd of the Village of Owego for Resisting Arrest, a Class A Misdemeanor and Disorderly Conduct, a Violation. Wayne Floyd was arraigned by Justice Craig and remanded to the Tioga County Jail on $5,000 cash bail.

On Sept. 8, the Owego Police arrested James Baker, age 43 of the Village of Owego for Criminal Possession of a Controlled Substance 7th, a Class A Misdemeanor, Resisting Arrest, a Class A Misdemeanor, Aggravated Unlicensed 3rd degree, a Misdemeanor, Reckless Driving, a Misdemeanor, Unlawful Fleeing a Police Officer in a motor vehicle 3rd, a Misdemeanor, and Unlawful Possession of Marijuana, a Violation. James Baker was held on violation of his Parole.

On Sept. 8, the Owego Police arrested Nicole Haines, age 26 of the Town of Owego for Criminal Possession of a Controlled substance 7th, a Class A Misdemeanor and Obstruction of Governmental Administration, a class A Misdemeanor. Nicole Haines was issued an appearance ticket to return to Village of Owego Court on Sept. 15, 2015.

On Sept. 8, the Owego Police arrested two 16-year-old males from the Village of for Unlawful Possession of Marijuana, a Violation and Violation of Village Curfew. Defendants were issued an appearance ticket to return to Owego Village Court on Oct. 6, 2015.

On Sept. 10, the Owego Police arrested Terri Glosenger, age 54 of the Village of Owego for Harassment 2nd, a Violation following a Domestic Incident. Terri Glosenger was issued an appearance ticket to return to the Owego Village Court on Oct. 6, 2015.

On Sept. 11, the Owego Police arrested Gary Wilson, age 34 of the Village of Owego for a Barking Dog, a Village of Owego Code Violation. Gary Wilson had been previously warned and had failed to comply. Wilson was issued an appearance ticket to return to Owego Village Court on Oct. 6, 2015.

On Sept. 13, the Owego Police arrested Gary Wilson, age 34 of the Village of Owego for Disorderly Conduct, a Violation. Gary Wilson was issued an appearance ticket to return to Owego Village Court on Oct. 6, 2015.

The Owego Police arrested Kimberly J. Spicer, age 22 of Willseyville, N.Y. on a charge of Tampering with Physical Evidence, a Class E Felony. Charges are the result of a Tioga County Grand Jury indictment. Kimberly Spicer was arraigned before Judge Keene and bail was set $10,000.

The Owego Police arrested Lynda Buck, age 64 of Owego, N.Y. on Tuesday, Sept. 15 for Disorderly Conduct, a violation, after complaints were filed with the Police Department that she was annoying the neighborhood by playing her music at an unreasonable level. Lynda Buck is due back in Owego Village Court on Oct. 6.

On Wednesday, Sept. 16, the Owego Police arrested Dennis Munday, age 64 of Owego, N.Y. for Criminal Trespass in the Second Degree, a Class A Misdemeanor, following a complaint of persons living in a condemned building. Dennis Munday was issued an appearance ticket to appear before Village of Owego Court at a later date.

The Owego Police arrested Patrick O’toole Jr., age 36, of Wernersville, Pa. on charges of Fugitive from Justice warrant. Charges are the result of an investigation into a report of suspicious persons in a van parked in the Price Chopper Parking lot in Owego. Upon investigation Officers discovered Patrick O’toole Jr. is wanted out of Pennsylvania for a parole violation. Patrick O’toole Jr. was brought before Town of Owego Justice Hogan and remanded to the Tioga County Jail as a fugitive from Justice.

On Sept. 19, the Owego Police arrested Gregory L. Frakes, age 44 of Owego, N.Y. Gregory L. Frakes is charged with Felony DWI, Aggravated Unlicensed Operation of a Motor Vehicle, 1st Degree, a Class E Felony, Operating a Motor Vehicle without an Interlock Devise, a Misdemeanor, and Refusal to Submit to aBreath Test. The charges are the result of a vehicle stop at 6:47 p.m. on Main Street in the Village of Owego. Frakes was arraigned before Village of Owego Court and remanded to the Tioga County Jail on $10,000 bail.

The Owego Police arrested 78-year-old Joseph Okrepkie of Newark Valley for Facilitating Aggravated Unlicensed Operation of a Motor vehicle in the 2nd Degree, a Misdemeanor. Joseph Okrepkie was issued a traffic citation to appear in Village of Owego Court at a later date.

Whitney Point man arrested in connection with Newark Valley robberyThe Tioga County Sheriff’s Department has reported that Tyler W. Johnson, age 26, of 3110 State Route 206, Whitney Point, N.Y. was arrested on Sept. 21, 2015 for Petit Larceny

This charge resulted from an investigation of a larceny that occurred on July 3, 2015 in the Village of Newark Valley at Village Wine and Spirits.

The defendant was arraigned before Justice John Schaffer of the Town of Newark Valley Court and was released on his own recognizance.

Tyler W. Johnson is scheduled to reappear before Justice Schaffer on Oct. 13, 2015.

NYSP investigating a hunting accident in Broome County

NYSP investigating a hunting accident in Broome CountyOn Sept. 26, 2015, at about 1:52 p.m., the New York State Police at Deposit responded to a Broome County 911 report of a hunting accident on state property off of Marsh Pond Road in the Town of Sanford.

According to state police, an investigation determined that two separate groups of hunters were legally hunting squirrels on state land off of Marsh Pond Road when Duane L. Wayman, 45, of Binghamton, N.Y. fired his .410 gauge shotgun at a grey squirrel; he failed to observe another hunter who was standing in his line of fire and accidentally shot him.

The other hunter, Andy M. Patrick, 50, of Johnson City, N.Y. was injured by three pellets that struck him near his right eye, the right side of his chest and his left shoulder.

Andy M. Patrick was transported to Wilson Memorial Medical Center for his non-life threatening injuries by Broome County Volunteer Emergency Squad.

All hunters possessed valid licenses.  New York State Environmental Conservation Police responded to the scene and the investigation is ongoing.

NYSP arrest Owego man for possessing and promoting child pornography

Pictured, Mark Moseman, 49, of 61 North Ave., Apartment 2F, Owego, N.Y., was arrested on Oct. 1, 2015 for the class E felony of possessing a sexual performance by a child less than 16 years old and the class D felony of promoting a sexual performance by a child less than 17 years old.

On Oct. 1, 2015, New York State Police and the Village of Owego Police Department executed a search warrant at 61 North Ave., Apartment 2F, in the Village of Owego.

As a result, the New York State Police in Owego have arrested Mark Moseman, 49, of 61 North Ave., Apartment 2F, Owego, N.Y. for the class E felony of possessing a sexual performance by a child less than 16 years old and the class D felony of promoting a sexual performance by a child less than 17 years old.

These charges related to digital child images that he possessed and disseminated using the internet.

This search warrant resulted from a joint investigation with the New York State Police Computer Crime Unit following cyber tip and leads developed.

Moseman was arraigned in the Town of Owego Court and remanded to the Tioga County Jail in lieu of $15,000 cash bail or $30,000 property bond.

Binghamton taxi company owners arrested for Medicaid fraudIn a press release received Monday, Attorney General Eric T. Schneiderman today the arrests of Kenneth Cohn and Sharon Cohn, who owned and operated a transportation company in Broome County, Yellow Medi-Van and Taxi, Inc., for allegedly violating the Workers’ Compensation law and illegally obtaining over $1 million from the Medicaid system.

“Our state’s Workers’ Compensation laws exist for a reason – to protect employees in the event of an accident,” Attorney General Schneiderman said. “Those who knowingly disregard these regulations and simultaneously defraud Medicaid will be held accountable.”

In the press release, New York Inspector General Catherine Leahy Scott said, “This husband and wife’s alleged million dollar theft from taxpayers was enabled through a trail of fraud and deceit, uncovered by my investigation, that purposefully misled regulators and left their own employees exposed and vulnerable. I want to thank Attorney General Schneiderman and his office for prosecuting this matter.”

Yellow Medi-Van and Taxi, Inc. received payments from the Medicaid Program for transporting Medicaid beneficiaries to medical appointments. During the period June 2, 2012, to Jan. 30, 2014, the defendants are alleged to have knowingly operated the company in violation of Broome County transportation regulations, including not having worker’s compensation insurance. During the time the company was operated unlawfully, the Cohn’s obtained over $1 million in Medicaid payments.

The felony complaint alleges that, in addition to not having the required insurance, the defendants submitted license applications for the company that falsely claimed the company had the required insurance, including attaching copies of insurance certificates, listing insurance companies that do not provide workers’ compensation insurance.

In addition, by knowingly operating a business with more than five employees without Workers’ Compensation Insurance, Workers’ Compensation Fraud Inspector General, the defendants’ violated New York Workers’ Compensation law, which makes it a felony to fail to have such insurance.

Defendants Kenneth Cohn, 68, and Sharon Cohn, 64, of Binghamton, N.Y. and Yellow Medi-Van and Taxi, Inc. are charged with Grand Larceny in the First Degree, in violation of Penal Law § 155.42, a Class B Felony (1 count); Offering a False Instrument for Filing in the First Degree, in violation of Penal Law § 175.35(1), a Class E Felony (2 counts); and Effect of Failure to Secure Compensation, in violation of Workers’ Compensation Law § 52(1)(a), a Class E Felony (1 count).

Hon. William Pellela, City Court, Binghamton N.Y arraigned the defendants.

The Attorney General thanks the Office of the Inspector General of New York State, the New York State Workers’ Compensation Department, Investigator Craig A. Cihocki, and the Broome County Government Security Division for their assistance in this investigation.

The Charges against defendants are accusations, who are presumed innocent unless and until proven guilty in a court of law.

The investigation by the New York State Attorney General’s Medicaid Fraud Control Unit was conducted by Special Investigator Keith Hall, under the supervision of Regional Chief Investigator William Faulk, Senior Auditor/Investigator Dejan Budimir, led by Regional Chief Auditor Thomas Goodman, and the matter is being presented in court by Ralph D. Tortora, III, Syracuse Regional Director. Catherine Wagner is Chief of Criminal Investigations-Upstate.

Acting Director Amy Held and Assistant Deputy Attorney General Paul J. Mahoney lead the Medicaid Fraud Control Unit. Executive Deputy Attorney General Kelly Donovan leads the Division of Criminal Justice.

NYSP arrested an armed Endicott man for several felony charges after pursuit in Owego

On Oct. 26, 2015, at about 5:31 p.m., New York State Police in Owego were attempting to locate a 2001 Dodge Dakota pickup truck that was being operated by Phillip P. Williams, 32, of Endicott N.Y., who had made threats to do harm to himself and others, and was armed with a rifle.

Troopers observed the vehicle and attempted a traffic stop in the Village of Owego. After failing to comply, Phillip P. Williams continued driving and eventually entered Pennsylvania where the Pennsylvania State Police were advised.

Phillips P. Williams was later observed driving on Pennsylvania Avenue at approximately 7:36 p.m., and again refused to stop for officers.

The pursuit terminated on State Route 434 in the Town of Owego. Phillip P. Williams was arrested after a brief struggle and after he threatened and menaced, approaching police officers with a rifle.

Phillip P. Williams was charged with the class D felonies of criminal possession of a weapon 3rd, menacing a police officer, assault 2nd the misdemeanors of fleeing a police officer in a motor vehicle 3rd, reckless endangerment 2nd, criminal possession of a weapon 4th, reckless endangerment 2nd, aggravated harassment 2nd and numerous traffic violations.

Phillip P. Williams was arraigned in the Town of Owego court and remanded to the Tioga County jail with no bail set.

The New York State Police were assisted by the Tioga County Sherriff’s Office and the Village of Owego Police Department.

State Police arrest Director of the Windsor Youth Sports Programs for stealing over $18,000

On Nov. 5, 2015, New York State Police at Binghamton arrested Robert E. Crowley, 57, of Windsor, N.Y. for two counts of the class D Felony of Grand Larceny 3rd.

This arrest was a result of an investigation that began on Oct. 19, 2015, when it was reported that money was missing from the bank accounts of the Windsor Youth Sports Programs.

According to the New York State Police, an investigation determined that over $18,000 was stolen by Robert E. Crowley, who is the current director of the program.

Robert E. Crowley was arraigned in the Town of Windsor court and was released without bail required. The investigation is ongoing.

Updated: Recycling employee killed in fatal accident, driver charged

Recycling worker killed in fatal accident in Owego

On Nov. 9, 2015 at 11:30 a.m., the Tioga County Sheriff’s Office investigated a fatal motor vehicle accident involving two cars and a pedestrian in the area of 3550 Pennsylvania Ave. in the Town of Owego.

According to the Tioga County Sheriff’s Office, a Taylor Recycling truck and pedestrian were struck by a southbound vehicle operated by Donald L. Ulmer, age 72, of Little Meadows, Pa.

The Taylor’s employee was identified as Sean R. Tilghman, age 27, of Endicott, N.Y. Sean R. Tilghman was pronounced dead at the scene by Tioga County Coroner Bob Williams.

Donald L. Ulmer was charged with Aggravated Unlicensed Operation in the third degree and is scheduled to appear in the Town of Owego Court on Dec. 15, 2015 at 9 a.m.

The Sheriff’s Office was assisted by the Apalachin and Campville Fire Departments.

Methamphetamine Manufacturing arrests made in Cortland County

On Feb. 18, 2016, the New York State Police Community Narcotics Enforcement Team (CNET) with assistance from the Cortland County Drug Task Force initiated a traffic stop on Squires Street in the City of Cortland during a methamphetamine investigation.   In addition, a search warrant was executed at 44 Owego St., Apartment 2 in the City of Cortland, Cortland County which led to the discovery of methamphetamine manufacturing materials in the apartment.

As a result of the investigation, James E. Duff, age 37 and Samantha B. Albanese, age 30 both of 44 Owego St., Apartment 2, Cortland, New York were arrested for Unlawful Manufacture of Methamphetamine in the Third Degree a Class D Felony, and two counts of Criminal Using Drug Paraphernalia in the Second Degree a Misdemeanor.

Both defendants were arraigned in Cortland City Court. James E. Duff was remanded to the Cortland County Jail on $5000 cash or $10,000 bond. Samantha B. Albanese was released without bail.

During the investigation Investigator’s seized lab equipment consisting of coffee filters, tubing and measuring cups, a spent “one pot” lab, reagents and solvents including Colemen lantern fuel and drain opener, precursors consisting of over 100 pseudoephedrine pills, scales, drug packaging material, approximately two grams of methamphetamine, a small amount of marihuana and $1,150.00 in U.S. Currency.

The New York State Police Contaminated Crime Scene Emergency Response Team (CCSERT) responded to the scene, and removed the hazardous materials located in the apartment during the search warrant.

Three subjects arrested for cocaine possession in Cortland County

On Feb. 17, 2016, the New York State Community Narcotics Enforcement Team (CNET), with assistance from Troop “C” Uniform Force and the Cortland County Drug Task Force arrested the following subjects after executing a search warrant on their vehicle during a traffic stop on I-81 in the Town of Homer, Cortland County.

Thelvan E. Hardy, age 39 of 623 Park St., Syracuse, N.Y., was arrested for Criminal Possession of a Controlled Substance in the Third Degree a Class B Felony.

Rhonda L. Couch, age 36 of 1148 Route 221, Marathon, N.Y. was arrested for Criminal Possession of a Controlled Substance in the Third Degree a Class B Felony, Criminally Using Drug Paraphernalia in the Second Degree a Misdemeanor, DWAI Drugs, and Aggravated DWAI Drugs with  a child in vehicle (Leandra’s Law).

Taylor M. Latta, age 21 of 915 Alfred Lane, Homer, N.Y. was arrested for Criminal Possession of a Controlled Substance in the Seventh Degree a Misdemeanor and Endangering the Welfare of a Child a Misdemeanor.

Seized during the search warrant was approximately three grams of cocaine and crack cocaine, a digital scale with cocaine residue, cellophane wrappers, cell phone, stem pipes, a marihuana pipe and $2,871.00 in U.S. Currency.

Thelvan E. Hardy was arraigned before the Homer Town Court and remanded to the Cortland County Jail on $7,500 cash or $15,000 bond.

Taylor M. Latta was release on an appearance ticket to appear in the Homer Town Court on March 1, 2016.

Taylor Latta’s 3-year old child was a passenger in the vehicle, which led to the Leandra Law Violation and Endangering Welfare of a Child charges. The child was turned over to a family member.
